This week, Boise's City Council is deciding the fate of the Eckert Bridge, a structure that would extend further over one of the city's key waterways while keeping the floodplain and wetlands intact. It sounds like a routine planning decision. But it sits inside a much bigger question the Treasure Valley hasn't fully answered yet: as the region grows, who actually has priority access to the water underneath your feet?
That question got a lot more complicated when data centers started arriving in Kuna. These facilities use water on a scale most residents haven't had to think about before. And Idaho's water law was written more than a century ago, long before anyone imagined a tech company would be competing with farmers and homeowners for groundwater in Canyon County.
Most Treasure Valley homeowners have no idea how this works. Here's what you need to know.
What's Happening in Kuna Right Now
Major technology companies are building large data centers in and around Kuna, with more projects in the permitting pipeline for Star and the broader Canyon County corridor. These facilities require enormous amounts of water, primarily for cooling systems that prevent server equipment from overheating.
A single large data center can use between 1 million and 5 million gallons of water per day, depending on the cooling system design and the ambient temperatures in the area. For comparison, the average Idaho household uses roughly 150 to 200 gallons per day. One large data center can consume as much water as 5,000 to 33,000 homes combined.
Kuna sits in Canyon County, which draws heavily from the Eastern Snake River Plain Aquifer. That same underground water system supplies private wells across Canyon and Ada counties and helps recharge municipal supplies serving Meridian, Nampa, Caldwell, and the surrounding cities. The aquifer is a shared resource, and what happens to it in one part of the valley ripples outward.

How Idaho Water Rights Actually Work
Idaho follows a legal doctrine called prior appropriation, often summarized as "first in time, first in right." The state's water law is built on this principle, and understanding it explains a lot about what's at stake as new industrial users enter the picture.
Every water right in Idaho has a priority date, which is the date the claim was established and recorded with the Idaho Department of Water Resources. When water becomes scarce enough that there isn't enough to go around, the system resolves competing claims by priority date. The senior rights holder (earliest date) receives their full allocation first. Junior rights holders only get water after senior rights are satisfied. If the water runs out, the most junior holders get nothing.
This system was designed for agriculture in the 1800s. Farmers who built the first irrigation canals in a watershed held senior rights. Later settlers received junior rights and accepted the risk of dry years.
In 2026, a data center filing for new water rights receives a 2026 priority date. That date will be senior to any well drilled or water right established after it. It doesn't matter that your family has lived in Meridian for 20 years. Under Idaho water law, a data center with a 2025 priority date is legally senior to a new residential development permitted in 2027.
This is not speculation. It is the law as written.
Municipal vs Well Water: Why Your Supply Type Matters
Not all Treasure Valley residents face the same level of risk here. The critical variable is whether you receive city water or draw from a private well.
City water customers in Boise, Meridian, Eagle, and Nampa: Your water comes from a municipal system. Those municipalities hold their own water rights, and most of those rights have priority dates going back decades. The City of Boise's water rights, for example, include senior claims tied to infrastructure built in the early 1900s. Your municipal supply has meaningful legal protection. A data center entering the market today is not going to bump Boise city water customers in a shortage scenario.
Well owners in Canyon County, Ada County, and the rural valley: You hold an individual water right tied to the date your well was permitted. If your well was drilled in 2018, your priority date is 2018. Any data center, industrial user, or even a neighboring well drilled after 2018 is junior to you. But any water right established before 2018 is senior, and those senior holders get first claim when levels drop.
The 2026 drought has already caused measurable drops in aquifer levels across Canyon and Ada counties. The Idaho Department of Water Resources issued the Canyon County well moratorium this year in part because the aquifer is under more stress than it has been in decades. Adding large industrial water users to that stressed system is a real concern for junior well owners, not a hypothetical one.
What Aquifer Stress Does to Your Water Hardness
Here's the water quality angle most homeowners miss, and it affects city water customers too.
Treasure Valley groundwater is already among the hardest in the region. Boise municipal water typically measures between 10 and 15 grains per gallon. Meridian commonly runs 12 to 17 grains per gallon. Canyon County well water can exceed 20 grains per gallon depending on depth and location. The hardness comes from dissolved calcium and magnesium picked up as water moves through the valley's geology.
When aquifer levels drop, mineral concentrations tend to increase. Water that sits in rock for longer periods, or that draws from deeper and denser mineral layers, picks up more dissolved solids. This is basic chemistry, and it has already shown up in testing data from the 2026 drought season. Several homeowners in Kuna and Star who tested their water this summer found noticeably higher hardness readings than they had recorded in previous years. More scale on fixtures, water heaters fouling faster, shower glass clouding over sooner.
If sustained industrial water use adds ongoing stress to the aquifer, this concentration effect is likely to persist and intensify over time. It won't happen overnight, but the trend matters for how you manage your home's water treatment systems.
The Floodplain Connection: Why the Bridge Decision Matters
Back to the Eckert Bridge. One of the central arguments in the City Council debate is that preserving floodplain and wetland areas is essential for the long-term health of the aquifer. Floodplains absorb runoff, slow erosion, filter contaminants, and allow water to percolate back into the ground. When development encroaches on those areas, whether it's a bridge footprint, a parking lot, or a large industrial facility with impermeable surfaces, it reduces the natural recharge capacity that replenishes the groundwater supply.
The city staff's careful analysis of how even one bridge affects wetland function reflects a principle that will need to be applied at a much larger scale as the data center buildout in Kuna proceeds. How these facilities manage stormwater, how much impermeable surface they create, and whether their operations affect the natural recharge zones around them are questions the Treasure Valley will need to answer, and track over time.
What Treasure Valley Homeowners Should Do Right Now
You can't change Idaho's water rights laws, and most homeowners don't need to become water policy experts. But there are practical steps worth taking now, before the next drought cycle or the next wave of development adds more stress to the system.
